Annex to the declaration for foreign companies

The legal responsibility to declare packaging falls on the Spanish importers. Therefore, on the rare occasion when an importer agrees with its foreign provider that the latter will be the one to declare the packaging, it must be reported to Ecoembes. In order to do that, the foreign supplier associated with ECOEMBES must fill out the Annex for Foreign Companies every year included in the Annual Packaging Declaration. Through this he should identify the clients on whose behalf he is declaring the packaging, as well as the quantities sold, by client and the brand in question.

Cases in which the foreign company should not request membership in Ecoembes

• When there are subsidiaries or entities of its own group in Spain that qualify as packagers under the terms of the Packaging Law; that is, when these subsidiaries sell the products supplied by the foreign company. In this case, the Spanish subsidiary shall be the one to have to join ECOEMBES.
• The foreign companies should not contribute for packaging for store brands or any other brand of which their Spanish clients are owners or licensees. In this case, said responsibility would have to fall on the Spanish client.
