A store brand is considered to be any individual brand that is marketed exclusively in the businesses of said brand's distribution chain or chains associated with the group.
Article 2.12 of the Law’s regulations establishes that in the case of products placed on the market as store brands, a packager will be considered to be that which is presented to the public as such by labeling the package with its name, corporate name, brand...in such a way that it can be unequivocally identified as the packager.
When the packager is not identified on these products as specified above, compliance with legal obligations will be the responsibility of the owner of the store brand that sells the product.
So, who should declare and contribute for the brand packaging?
For example, if the packaging only shows some of the packager's identifying information mentioned above, without any express mention of what it represents, the brand's owner will have to declare the packaging.
Otherwise, if the wording "Envasado por..." ("Packaged by...") appears, followed by any of the identifying information mentioned above, the packager will have the obligation to contribute to the SIG.
