Legal concept of bag provided in shops: those bags provided by or acquired in shops for the transport of merchandise by the consumer or final user. The most common examples are bags with handles (T-shirt bags) or section bags such as those used to pack products in bulk (fruit, sweets, meats, etc.) at the time of sale.

 

Responsibility in connection with the Packaging Law.

Royal Decree 782/1988 of April 30 establishes that these bags constitute packaging and that the responsible party is the owner of the SHOP which supplies them. However, manufacturers, acquirers within the European Union or importers of these bags may voluntarily act as intermediaries between the Shop and Ecoembes.

The shop may ask any manufacturer or bags supplier who has voluntarily joined Ecoembes through having signed a voluntary Agreement to manage the declaration and the Green Dot contribution for the bags which the shop places on the market. 

 

 

The manufacturer or supplier shall pass the Green Dot cost on to the shop in the invoices it issues to the shop. This amount must explicitly appear in each invoice, so that the shop can verify and demonstrate its compliance with its legal obligations.

The Agreement shall only be valid for bags supplied in shops and shall not be applicable to other types of packaging.
